These Terms are an agreement between you and ICONICFJ US LLC, which operates FixMyGPS. By using our website, partner portal or mobile app (the “Services”) you agree to them and to our Privacy Policy. If you do not agree, do not use the Services.
What FixMyGPS is
FixMyGPS connects people and businesses that need GPS tracker, ELD, dashcam and telematics installation or repair with independent Partner Companies and their Technicians. FixMyGPS coordinates requests, dispatch, evidence review and payouts. Installation work is performed by Partner Companies, not by FixMyGPS.
Accounts
- You must provide accurate information and keep your sign-in credentials secure. You are responsible for activity under your account.
- You must be at least 18 and able to form a binding contract.
- Partner Companies are responsible for their Technicians’ accounts and conduct. Technicians are employees or contractors of the Partner Company, not of FixMyGPS.
- You can delete your account at any time. See Delete your account.
Customers
- Requests and quotes are not binding until a Technician is assigned and the job is confirmed with you.
- You confirm you own, or are authorized to modify, the vehicle or equipment, and that you have any consent required to install tracking or recording devices.
- Pricing, trip, wait-time, no-show and return-visit fees will be disclosed before work begins.
Partner Companies and Technicians
- You must complete onboarding, including identity and business verification, a W-9, and valid certificates of insurance, before receiving payouts.
- You are an independent business. You control how you perform work, and are responsible for your own taxes, licenses, insurance and compliance with law.
- Job evidence (photos and device scans) must be captured in the app at the time of work. Fabricated, reused or altered evidence is grounds for immediate removal and non-payment.
- Location is tracked only during an active job and only with your consent, as described in the Privacy Policy.
- Offers are accepted on a first-come basis; prices may change between offer waves. Payouts are made by bank transfer on a weekly schedule after the work is approved, less any amounts disputed or owed.
- Additional payment terms in your Partner agreement apply and control if they conflict with these Terms.
Acceptable use
You agree not to:
- break the law, or install tracking devices on property or people without authorization;
- submit false information or evidence, or impersonate anyone;
- interfere with, scrape, reverse engineer or attempt to bypass security of the Services;
- use the Services to harass, stalk or surveil another person; or
- upload malicious code.
Content you submit
You keep ownership of what you submit. You grant FixMyGPS a limited license to store, process, display and share it as needed to operate the Services, resolve disputes and meet legal obligations.
Suspension and termination
We may suspend or end access if you breach these Terms, create risk or legal exposure, or for inactivity. You may stop using the Services or delete your account at any time. Sections that by nature should survive (payment obligations, disclaimers, liability limits, disputes) will survive.
Disclaimers
The Services are provided “as is” and “as available” without warranties of any kind, to the extent permitted by law. We do not guarantee uninterrupted service, that a Technician will be available in your area, or the performance of third-party devices and tracking platforms.
Limitation of liability
To the extent permitted by law, FixMyGPS is not liable for indirect, incidental, special, consequential or punitive damages, or lost profits or data. Our total liability for any claim relating to the Services is limited to the greater of the amounts you paid or received through the Services in the 12 months before the claim, or US$100. Some jurisdictions do not allow certain limits, so they may not apply to you.
Indemnity
You will defend and indemnify FixMyGPS against claims arising from your misuse of the Services, your breach of these Terms, or the work you perform or request.
Governing law and disputes
These Terms are governed by the laws of the State of Connecticut, without regard to conflict-of-law rules. Courts located in Connecticut have exclusive jurisdiction, except that either party may seek injunctive relief in any competent court. Please contact us first so we can try to resolve any dispute informally.
Changes
We may update these Terms. We will post the new version here and update the date above. Continued use after a change means you accept it.
